1.2 When we refer to "Jaguar Land Rover SA", "JLRSA", "we", "our", or "us" in this Privacy Policy, we refer to: Jaguar Land Rover South Africa (Pty) Limited, whose registered office is at: 28 Victoria Link Route 21 Corporate Park, Nellmapius Drive, Irene X30, Centurion, Tshwane, Gauteng, South Africa, and whose registered number is: 2001/027269/07.
1.3 This Privacy Policy describes how we will treat your Personal Information whether provided by you to us or collected by us through other means in your access and use of our website at www.buy.landrover.co.za and www.landrover.co.za ("Website") and when you purchase any goods or services from us, or agents acting on our behalf.
1.4 This Privacy Policy must be read together with any Website terms and conditions and any other documents or agreement that describe the manner in which we, in specific circumstances, collect or process Personal Information about you. This will enable you to understand the manner in which JLRSA will process your Personal Information. 2. WHAT IS PERSONAL INFORMATION

When we perform one or more of these actions, we are "Processing" your Personal Information.

2.3.14 Social Media Information, which includes, your interactions with our social media pages, anycomments made on our social media pages and any information or personal information which you submit to us using our social media pages' direct messaging functionality.
2.4 JLRSA may also process, collect, store and/or use aggregated data, which may include historical or statistical data ("Aggregated Data") for any purpose. Aggregated Data may be derived from your Personal Information but is not considered Personal Information, as this data does not directly or indirectly reveal your identity. However, if we combine or connect Aggregated Data with your Personal Information in a manner that has the result that it can directly or indirectly identify you, we will treat the combined data as Personal Information, which will be managed in accordance with this Privacy Policy.
3. HOW WE COLLECT YOUR PERSONAL INFORMATION
3.1 We collect your Personal Information in three ways, namely:
3.1.1 through direct or active interactions with you;
3.1.2 through automated or passive interactions with you; and
3.1.3 from third parties, including third party service providers.
3.2 Direct or active collection from you
3.2.1 We may require that you submit certain information to enable you to access portion of the Website, to make use of our services, to purchase our goods or services, to facilitate the conclusion of an agreement with us, or that is necessary for our fulfilment of our statutory or regulatory obligations. 3.3 Passive collection from your Access Device
3.3.1 We may passively collect certain of your Personal Information from the Access Device that you use to access and navigate the Website (each an "Access Device"), by way of various technological applications, for instance, using server logs to collect and maintain log information.

3.4.1.3 third parties (including public bodies) that maintain public information about you, including regulators, professional or industry organizations and certification/ licensing agencies, marketing, sales generation, and business partners, SAPS, Home Affairs, Credit bureaus, TransUnion and similar entities; and
3.4.1.4 our information technology suppliers.
4. HOW WE USE YOUR PERSONAL INFORMATION
4.1 We use the Personal Information we collect from you to maintain and improve our services and transactions onsite or in person via our Website and to improve the experience of our users, to facilitate the sale of our products and the provision of our services and to fulfil our statutory and regulatory obligations.

4.2.28 to process your personal data as appropriate or necessary under applicable laws for purposes of reviewing restricted and ordinary persons and sanctions lists, preventing money laundering, financing of terrorism and other (financial) crimes and to respond to requests from public and government authorities.
5. COMPULSARY PERSONAL INFORMATION AND CONSEQUENCES OF NOT SHARING WITH US
5.1 Where JLRSA is required to process certain Personal Information by law, or in terms of a contract that we have with you, and you fail to provide such Personal Information when requested to do so, JLRSA may be unable to perform in terms of the contract we have in place or are trying to enter into with you. In this case, JLRSA may be required to terminate the contract and/or relationship, upon notification to you, which termination will be done in accordance with the terms of the contract and all applicable legislation.
In the clause above, you agree and accept that there is certain compulsory Personal Information you must provide us with if you want to enjoy our services and the features and functionality on the Website. If you decide not to provide us with such compulsory Personal Information, you agree that we may limit our ability to provide goods and services to you, as well as certain features and functionality on the Website. |
6. WHO WE SHARE YOUR PERSONAL INFORMATION WITH
6.1 We may share your Personal Information with:

6.1.4 Third parties in the event we sell or buy any business or assets; and
6.1.5 If we are under a duty to disclose or share your Personal Information in order to comply with any legal or regulatory obligation or requests, or in order to enforce these terms or to investigate actual or suspected breaches or to protect or pursue your, our or a third party's legitimate interest.
6.2 We have safeguards in place with our service providers to ensure that your data is kept confidential, safe and secure and used in accordance with the purposes set out in this Privacy Policy.
7. INFORMATION ABOUT DATA TRANSFERS
7.1 We may share the Personal Information described in this Privacy Policy with suppliers or group companies located inside or outside South Africa, where this is necessary for the purposes described above. Where this happens, we apply safeguards to add to the data protections that apply to those data transfers. This includes an assessment of the persons who we are sharing the data with, their security controls, the adequacy of data privacy laws applicable in any third country where the recipient of the information or data resides or is located, the use of European Commission or other country approved model contract terms.

9.1.4 Request erasure of your Personal Information, where there is no lawful basis for the retention or continued processing of it.
9.1.5 Object to the processing of your Personal Information for legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms.
9.1.6 Request restriction of processing of your Personal Information. This enables you to ask JLRSA to suspend the processing of your Personal Information in limited circumstances, which may differ by jurisdiction.
9.1.7 Withdraw consent previously given in respect of the processing of your Personal Information at any time which withdrawal of consent will not affect the lawfulness of any processing carried out prior to your notice of withdrawal. Withdrawal of consent may limit the ability of JLRSA or a third party to provide certain products or services to you, but will not affect the continued processing of your Personal Information in instances in which your consent is not required.

12. CHANGES TO THIS PRIVACY POLICY
